General Terms and Conditions (GTC)

§ 1 Scope of Application

These General Terms and Conditions apply to all orders placed through the online shop Velomed. The operator and contractual partner is Velomed, Calle Jano 1 2A, 29010 Málaga, Spain.

§ 2 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By submitting the order, you make a binding offer to purchase. The contract is concluded with our order confirmation by email.

§ 3 Prices and Payment

All prices are stated in Euros (€) and are final prices including statutory value-added tax (where applicable), plus any shipping costs, which will be displayed before the order is completed.

We accept the following payment methods:

• PayPal
• Apple Pay / Google Pay
• Klarna (where available)

§ 4 Delivery and Shipping

Delivery will be made to the delivery address provided by the customer. The delivery time is usually 5–8 working days for deliveries to Germany. After the goods have been shipped, you will receive an email with a tracking number.

We ship to Germany, Austria, France, the Netherlands and other EU countries. The applicable shipping costs will be displayed to you during the ordering process.

§ 5 Right of Withdrawal and 30-Day Guarantee

As a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. You can find the complete withdrawal policy on our Right of Withdrawal page.

In addition, we offer a voluntary 30-day money-back guarantee. If you are not completely satisfied with your purchase, we will refund the full purchase price — no questions asked. Please contact us by email at staysmoothmalaga@hotmail.com.

§ 6 Warranty

The statutory warranty rights apply. In the event of defects, you are entitled to subsequent performance (repair or replacement delivery). Should subsequent performance fail, you can withdraw from the contract or reduce the purchase price.

§ 7 Retention of Title

The delivered goods remain our property until full payment of the purchase price.

§ 8 Limitation of Liability

We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health. Otherwise, our liability is limited to the foreseeable, contractually typical damage.

§ 9 Online Dispute Resolution

The EU Commission provides a platform for online dispute resolution:

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection regulations of the country in which the consumer has his habitual residence preclude this.
